Draft Administrative Rules of the Russian PTO

on consideration and settlement of disputes associated with intellectual rights protection

A draft Administrative Rules of the Russian PTO was published by the Russian Ministry of Economic Development on March 12, 2012, and public hearings connected with said draft will held till March 26, 2012.

The Administrative Rules establish a procedure for settling disputes arising in connection with intellectual rights protection in administrative proceedings.

In particular, the Administrative Rules determine:

• circle of applicants;
• requirements for notification of providing a government-rendered service;
• standard of providing a government-rendered service (description of a result, term, exhaustive list of documents required for a service to be rendered, etc.);
• content, sequence, terms of administrative procedures (actions) and requirements for carrying out the same;
• pretrial (extrajudicial) appellation of decisions and actions (omissions) of the Russian PTO, as well as officers thereof.
