IP law amendments to be effective in October
14 February 2014The long expected amendments to IP law have gone through the second reading in the Russian Duma. Now it will have to go through third reading (no changes or obstacles are expected) after which it will be signed by President and come in force on October 1, 2014. The package of amendments is quite comprehensive and will concern all subject matters of IP rights.
Some examples: in patents, in case of infringement the patentee will be able to claim compensation (no need to prove the amount) instead of damages. Now this option is available for trademarks and copyright only. Substantive examination of utility models will be introduced which will cut the ground from under the patent trolls feet. The obligatory «list of essential features» will be deleted from design applications. In trademarks rights, a provision is introduced to the effect that after publication of the application it will be possible to send objections to the PTO against granting protection to the trademark. There are also many other amendments.
