Сhanges made by Federal Law № 530-ФЗ of August 31, 2014 in Article 180 of the Criminal Code of the Russian Federation and Article 14.10 of the Code of Administrative Offences (CAO) came into effect
7 April 2015The changes are aimed at enhancing responsibility for the circulation of counterfeit products.
For this purpose, in particular:
in Article 180 of the Criminal Code the liability is increased for illegal use of the means of individualization of the goods (works, services): the low limit of the fine is set at 100 thousand rubles, and the top limit is increased to 300 thousand rubles (previously - 200 thousand rubles); new penalty was introduced in the form of correctional labour for up to 2 years, or imprisonment for up to two years with a fine of up to 80 thousand rubles or in the amount of the salary or other income of the convict for the period of up to 6 months. At that, the threshold amount of damage allowing to initiate criminal proceedings was reduced six fold (from 1.5 million to 250 thousand rubles);
Article 14.10 of the CAO has been amended to increase penalties for illegal use of the means of individualization of the goods (works, services): the amounts of the fines are increased (approximately 2 to 5 times), and it is provided that not only objects containing illegal reproduction of means of individualization shall be mandatorily confiscated , but also the materials and equipment used for their production, and other tools for committing the administrative offense.
