Description

A company located in Troitsk makes hand-painted pure silk products (shawls, scarves, wraps, panel pictures, curtains). In 1995, the company was classified as a company of Russian arts and crafts industry. Its products combine folk artistic traditions of hand-painted fabrics and modern creative improvisation of artists being masters in painting. In its activities, the company is widely using the designation “Troitsk Shawl” (Troitskiy platok) to individualize its products.

Solution

Having comprehensively studied the situation, to get the most effective protection of intellectual property, the trademark attorneys of Gorodissky & Partners have proposed to register the designation “Troitsk Shawl” as a geographical indication. An application for registration and granting of an exclusive right to the geographical indication “Troitsk Shawl” has become the first application for a geographical indication in the practice of Gorodissky & Partners after this subject matter had been introduced into the Civil Code of Russia (Federal Law No. 230-FZ dated 27 July 2020).

Result

Due to the concerted efforts of the trademark attorneys of Gorodissky & Partners and the applicant, the application has successfully passed the expert examination in the Russian PTO (Federal Service for Intellectual Property), a decision on state registration and granting of an exclusive right to a geographical indication has been made on this application, which will make it possible to identify the producer’s goods as originating from a certain area of a geographical location, and this fully corresponds to the business strategy of our client.
