10 February 2020

An article “By what rules disputes regarding protectability of industrial property objects are adjudicated” by Vladimir Mescheriakov, Counsel (Gorodissky & Partners, Moscow), was published in №1, 2020 issue of the “Patent Attorney” magazine.

The article provides an analysis of the law enforcement practice of the Russian PTO and the IP Court, indicating that along with the normatively established rules for resolving these disputes in an administrative order, these bodies apply other rules created by case-law decisions of these bodies, many of which actually change the normatively established ones.
